Objectives: There is a big debate about the role of data in society, with some people arguing that data is essential for the advancement of human rights, democracy and science, and others arguing that too much data can actually be detrimental. However, there is no doubt that data plays an important role thus the need of comprehensive regulation that ensures the right balance between fundamental rights and innovation.

The Data Governance Act (DGA) is the first legislative output of the European Strategy for Data (February 2020), and aims to set-up a framework to foster a new business model of data intermediation services, marked by neutrality, trust and sovereignty, and encourage data sharing among all actors of the European data economy. It also aims to facilitate the reuse of certain categories of protected public-sector data and codify new rules on “data altruism”. It creates a European Data Innovation Board to advise the Commission in enhancing the interoperability of data intermediation services and issuing guidelines for the development of the common European data spaces. It finally set out safeguards, with potential adequacy decisions, against unlawful international transfer and governmental access to non-personal data (from an IP and Trade Secrets protection perspective). A final compromise was found on 30 November 2021 and the final adoption by EU institutions is expected soon.

During the session we will discuss important aspects of the regulation relative to Data intermediation services, data marketplaces and data sharing both in a B2B, Open Data context, and conditions for the re-use of data held by public sector bodies.
