Objectives: What if traditional IP mechanisms for protecting and promoting innovation need to be alleviated? The COVID Health crisis revives the national, EU, and international debates on flexibility to patent rights for public interest, including health issues. From waivers to patent rights at stake at the WTO to modernized rules for Compulsory Licensing at the EU level and enhanced national legislation on this matter in many countries, public initiatives are burgeoning and blossoming in this respect. Are these initiatives serving all stakeholders, from member states to researchers, companies, and consumers?
